b. These conditions apply exclusively to natural persons who are not traders, hereinafter referred to as [USER], meaning any individual acting for purposes that do not fall within the scope of their professional, commercial, industrial, or craft activity;

c. The USER must carefully read the general terms and conditions of sale and expressly agree to them by clicking the button “I accept the general terms and conditions of sale”; therefore, if they do not agree, they should not place an order or make a purchase;

d. These general conditions shall not apply if it is determined, based on the order placed, that the USER is not a final consumer, as defined in subparagraph c) of Article 3 of Decree-Law No. 24/2014, of 14 February;

e. Tarefa Cordial Unipessoal, Lda. reserves the right, without prior notice, to add to, modify, or amend these general terms and conditions of online sale, to change the sale price, or to modify or replace the products available, it being understood that by placing a new order or making a purchase, the USER expressly accepts and agrees to be bound by the new terms, conditions, and sale prices.

1.2) USER is a natural person acting for purposes that do not fall within the scope of their commercial, industrial, craft, or professional activity, and who, through the use of the SITE, places product orders or purchases products;

1.3) PRODUCT or ORDER: an item listed on the SITE for online sale;

1.4) MADE-TO-ORDER PRODUCT: a product ordered by a user that is not available in stock.

8) Made-to-order products, hereinafter referred to as [ORDER], take on average up to two weeks to become available in the event of a stock shortage, or longer for specific products;

10) The SITE is updated with the utmost care; however, it is possible that price information may contain errors. Therefore, Tarefa Cordial Unipessoal, Lda. does not commit to the offer and reserves the right to cancel the order if such an error occurs;

11) Tarefa Cordial Unipessoal, Lda. declines any responsibility for possible errors that may occur on the SITE or for situations in which the SITE becomes inaccessible;

12) The weight indicated for each product on the SITE does not correspond to its exact weight but rather to an approximate weight, due to the inclusion of packaging materials used for shipping.

14) While browsing the SITE, you may add products to your shopping cart by clicking the “buy” / “add” button;

15) Once you have finished selecting your products, you can click on the “x products” / “Cart” option at the top of the SITE to proceed and complete your purchase;

16) In the “shipping” field, you may choose in-store pickup at our shop in Ponta Delgada, located at ______;

17) We deliver to mainland Portugal, the Azores islands, and Madeira islands;

18) There are no shipping costs for orders collected at the Ponta Delgada store;

19) Only orders for delivery within mainland Portugal and the Autonomous Regions of Madeira and the Azores will be accepted;

21) After entering your personal data, please also confirm your intention to place the ORDER;

23) Your ORDER will not be accepted, and the contract will not be deemed concluded until you receive, by email, confirmation of acceptance of the order and complete payment for it;

24) Payment must be made at the time of ORDER confirmation;

25) Payment must be made after the company confirms the existing stock and sends the final amount by email. If no objection is raised, you will have 48 hours to make the payment;

26) Accepted payment methods are: PayPal, Multibanco reference, MB Way, or bank transfer.

28) The shipping time will, in principle, be up to 48 hours on business days from the date of receipt and confirmation of payment of the ORDER by our company, except in cases of stock shortages, in which an alternative shipping time will be proposed. Customized products may take longer due to the personalization process;

29) If no one is present at the indicated address, the ORDER will be held at the local CTT or freight forwarder station for 3 business days. After this period, it will be returned to the company. Once this period has expired, the items will be returned to Tarefa Cordial Unipessoal, Lda., and the customer will be contacted to schedule a new delivery, the cost of which will be borne by the customer.

31) To benefit from this warranty, the USER must keep the invoice as proof of purchase;

32) The COMPANY is solely a reseller. All products sold by the COMPANY are not manufactured by us. The product warranty is provided by the respective manufacturer in accordance with the law, up to a maximum of 2 years from the date of purchase;

33) If you encounter difficulties with the installation or use of a product, first ensure that you are following all instructions provided in the manufacturer’s manuals. If the problem persists, contact the manufacturer directly or our company;

33.1) We make every effort to ensure that your product is replaced as quickly as possible, but the resolution time is not solely under our control. All products received at our facilities are tested and dispatched within a maximum of 48 hours. Beyond that, responsibility lies with the manufacturers and suppliers;

33.2) In the case of discontinued products, replacement may be made with an equivalent or superior product currently available on the market. This replacement is the responsibility of the supplier or manufacturer; if replacement is not possible, a refund may be issued.

34) The USER has the right to cancel the purchase if they do not receive their product within a maximum period of 30 days, with shipping costs being the responsibility of the customer;

35) The USER may freely terminate the contract concluded and executed on the SITE, under Article 10 of Decree-Law No. 24/2014 of 14 February, with the USER being responsible for any return costs or shipping. To exercise this right, the USER must, within a maximum of 14 days from the date of receipt, send the product to Rua Vinhas de Dentro 7, 9800-423 Urzelina, São Jorge, by registered mail with acknowledgment of receipt;

36) In the case of contract termination, the customer has a maximum period of 30 days from the date of receipt of the order to return to the company, at the address indicated above, the purchased product(s) with all its accessories and packaging, in excellent condition, without scratches or signs of use, together with the operating instructions, a copy of the sales invoice, and proof of order receipt, as detailed below:

a) – Books must be in their original condition, without signs of use, folds, marks, torn or creased pages, or writing;

b) – Films, TV, and Music: CDs, DVDs, vinyl, etc., with unopened packaging and intact seals;

c) – Software and Video Games with unopened packaging and intact seals;

d) – Electronics (TVs, Audio, Video, Computers, GPS, etc.) with products showing no signs of misuse. The product must be returned complete, with all components and accessories, instruction manuals, and original packaging in perfect condition;

e) – Clothing, Shoes, and Accessories in their original condition with all packaging and labels;

f) – Other products with no signs of misuse. The product must be returned complete, with all components and accessories, instruction manuals, and original packaging in perfect condition-

37) The consumer loses the right to freely terminate the contract if the above conditions are not met;

38) After receiving the returned order and all documents mentioned in the previous point, the company will refund the amounts paid by the customer, preferably using the same payment method if possible, within a maximum period of 14 days, without any cost to the customer, except for return or shipping costs.

38) The European Union has created a website to support consumers in submitting complaints regarding any dispute in which they are involved. In this context, the COMPANY provides all necessary information so that you can exercise your right to file a complaint with an official, third-party, and impartial entity. 39) All electronic messages sent during access to the online store, including emails and messages via an internet browser, shall be considered contractual statements for the purposes of applicable law;
